This Document may be translated into several languages; however, in the event of any discrepancy, contradiction, ambiguity or difference of interpretation between the Spanish version and any translated version, the version written in Spanish shall prevail in all cases, as it shall be the only legally binding version for the parties.
These General Terms and Conditions shall expressly govern the relationship arising between CHRISTIAN SCHUH and the client who contracts one of the services or programs previously described on the website.
These General Terms and Conditions must always be supplemented by the Legal Notice, as well as any other Specific or Particular Conditions that may be established in each case, and in all cases by Spanish Law.
CHRISTIAN SCHUH may at any time and without prior notice modify these General Terms and Conditions, as well as any Particular Conditions that may apply, by publishing such modifications on the Website so that they may be known and accepted by new Clients.
The acceptance and confirmation thereof when contracting the strategic advisory program implies the acceptance of each and every point of these General Terms and Conditions in force at that time, as well as the specific Particular Conditions if applicable.
Once the Client has contacted CHRISTIAN SCHUH, a copy of the General Terms and Conditions will be sent to the Client by email.
The user declares that they are of legal age and have the necessary legal capacity to use this Website in accordance with the General Terms and Conditions set out herein, which they fully understand and accept; as well as to contract the service in which they are interested.
CHRISTIAN SCHUH informs that the contracting process for any of the high-level strategic advisory programs offered is carried out as follows.
CHRISTIAN SCHUH currently offers four programs governed by the following terms, although the catalog of services may change at any time, and any new programs will also be governed by this document. If different conditions apply, the specific particular conditions will be established.
The duration of the program, the price and other conditions are published alongside the announcement of the program on the Website.
Through the web form or by email, the client will communicate which service or program they wish to contract and the relationship will be formalized by email. The program must be paid in advance and in full by bank transfer under the terms explained by CHRISTIAN SCHUH.
Upon formalizing participation, the client is entitled to a series of video-call meetings with CHRISTIAN SCHUH. This typically consists of an initial extended meeting and weekly follow-up meetings, although this may vary depending on the program chosen.
The user is responsible for treating confidentially and adequately safeguarding any passwords provided for accessing the Website, where applicable, preventing access by unauthorized third parties. Passwords may not be used in the terms set out in point 7 of the Legal Notice of the website bychristianschuh.com.
It is necessary to be of legal age, to communicate via the form or by email and to provide a series of personal data (governed by the Website’s Privacy Policy). The provision of false data or identity impersonation is prohibited.
From the moment the price is paid, the individual shall be considered a client.
The website bychristianschuh.com will display at all times the programs offered, as well as their price and duration.
CHRISTIAN SCHUH reserves the right to decide at any time which programs are delivered and services offered. Furthermore, new programs may be added at any time, which will be governed by the General Terms and Conditions in force at that time. CHRISTIAN SCHUH reserves the right to make any modifications deemed appropriate at any time and without prior notice, and may update products and services daily in response to market conditions.
By purchasing the program, the client is contracting access to CHRISTIAN SCHUH’s professional advisory services through meetings and mentoring sessions, which may vary depending on the high-level strategic advisory program contracted.
The language in which the purchase of the service is completed and the service is delivered shall be chosen by the Client, and may be Spanish, English or German.
The price of the Program is indicated and published on the website and includes IGIC (Canary Islands indirect tax). Please note that full payment of the program must be made in advance by bank transfer to the account number that will be provided.
Once the purchase has been made and payment verified, the user will receive confirmation of the order by email, which may be printed as proof of purchase. The order confirmation and proof of purchase (printed by the user) shall not be valid as an invoice.
CHRISTIAN SCHUH reserves the right to cancel orders based on errors, or orders with an incorrect or incomplete email address.
CHRISTIAN SCHUH allows the cancellation of the contracted program at any time, through a partial or full refund of the amount paid. If mentoring sessions have not yet commenced, the full amount paid may be refunded; otherwise, if the contracted service has already begun, a proportional refund will be made, deducting the services and sessions already provided.
CHRISTIAN SCHUH guarantees a good service and all rights guaranteed to consumers and users. Furthermore, the delivery of the Program is guaranteed unless there is a case of force majeure.
CHRISTIAN SCHUH makes every reasonable effort to offer the information contained on the Website truthfully and without typographical errors. Should an error of this nature occur at any time, entirely unrelated to the will of CHRISTIAN SCHUH, it will be corrected immediately. Should a typographical error exist in any of the prices displayed and should a client have made a purchasing decision based on said error, CHRISTIAN SCHUH will communicate the error and the client shall have the right to rescind the program purchase at no cost.
The Client undertakes to make lawful use of the service offered by CHRISTIAN SCHUH, without contravening applicable Laws, good customs, morality and public order; nor the rights of third parties. The Client guarantees the truthfulness and accuracy of the data provided.
Failure to comply with these obligations may result in the withdrawal or cancellation of the services offered by CHRISTIAN SCHUH without the Client having any right to compensation.
The Client may not assign, transfer or transmit the contracted rights, responsibilities and obligations.
When contacting the professional and formalizing the purchase, the User provides CHRISTIAN SCHUH with a series of personal data. It is necessary to read and accept the Privacy Policy.
This contract shall be governed by Spanish law, which shall apply to all matters not provided for in this contract regarding interpretation, validity and execution. The parties expressly waive any jurisdiction that may correspond to them and expressly submit to the courts of Santa Cruz de Tenerife for the resolution of any dispute that may arise from the interpretation or execution of these contractual conditions.
The total liability of Christian Schuh arising from the provision of strategic advisory services shall in all cases be limited to the total amount actually paid by the client for the contracted program or service.
Under no circumstances shall Christian Schuh be liable for indirect damages, loss of profits, loss of business opportunities, loss of data, or any consequential damages resulting from the use or application of the recommendations, analyses, or materials provided in connection with the services.
The client acknowledges that any business decisions taken on the basis of the strategic recommendations provided remain solely the responsibility of the client.
